(1)     The Federal Government of Nigeria has received financing from the World Bank toward the cost of the Niger Basin Water Resources Development and Sustainable Ecosystems Management Programme, and intends to apply part of the proceeds toward payments under the contract for the Construction and Installation of Reservoir Limit Beacons at Kainji and Jebba Dam Reservoirs.

(2)     The Project Management Unit of the Transmission Company of Nigeria Plc. now invites sealed bids from eligible bidders for fabrication of Pre-cast Reinforced Concrete Poles of square section 300mm x 300mm and 4000mm long of Grade C2 Concrete (M30) and installation of same along the rim of Kainji and Jebba Dam reservoirs as reservoir limit beacons.

(3)     Bidding will be conducted through the National Competitive Bidding procedures as specified in the World Bank’s Guidelines: Procurement of Goods. Works and Non-Consulting Services under IBRD Loans and IDA Credits & Grants by World Bank Borrowers – January 2011 (“Procurement Guidelines”), and is open to all eligible bidders as defined in the Procurement Guidelines. In addition, please refer to paragraphs 1.6 and 1.7 setting forth the World Bank’s policy on conflict of interest.

(4)     Interested eligible bidders may obtain further information from the Project Management Unit and inspect the bidding documents during office hours from 10:00am to 5:00pm local time at the address given below.

(4.0) Nigerian Content Requirements

  • Vendors are to demonstrate strict compliance with the provisions of Nigerian Oil & Gas Industry Content Development Act and will be expected to meet the following requirements at the Technical and Commercial tendering phase:
  • Demonstrate that the entity is a Nigerian Registered Company, or Nigerian Registered Company as the contracting entity in genuine alliance or joint venture with foreign company with details on scope and responsibilities of parties for this work. Such companies must show evidence of joint venture binding agreement duly signed by the CEO of both companies including evidence or plans of physical operational presence and set-up in Nigeria.
  • Demonstrate that the entity is a Nigerian indigenous registered company with 51% and above Nigerian Equity shareholding in the legal registered entity of tenderer in Nigeria and registered on the NCDMB NOGIC JQS in the relevant product category.
  • Tenderer to provide verifiable evidence of ownership, name of nominated vessel and registration as category A/AA/AAA on the NCDMB marine vessel categorization procedure.

Nigerian Indigenous company executing the work scope in alliance with foreign companies and multinational should ensure that:

(a) The foreign company or multinational is duly registered in Nigeria

(b) Submit CAC forms C02 and C07 of the both companies

(c) Submit binding Memorandum of Agreement (MoA) stating the following:

  • The Nigerian Indigenous company will be the lead of the partnership
  • The detailed scope of work to be performed by each party
  • Detailed personnel and equipment that each party will deploy to execute the work scope
  • The MoA will be governed by the laws of the Federal Republic of Nigeria
  • The MoA to be signed by the Managing Directors of both companies.
  • International or multinational company working through a Nigerian subsidiary must:

(a)     Demonstrate that the Nigerian subsidiary has 51% and above Nigerian equity shareholding in the ownership structure of the legal registered entity of tenderer in Nigeria and duly registered on the NCDMB NOGIC JQS as service providers under the applicable and relevant product category and

(b)     Demonstrate that a minimum of 50% of equipment to be deployed for execution of work shall be owned by the Nigerian subsidiary by providing a list of equipment for this tender and indicating those that will be owned by the Nigerian subsidiary.

  • Furnish details of company ownership and shareholding structure. Also submit clear photocopies of your CAC Forms CO2 and CO7
  • Provide evidence of what percentage of your key management positions is held by Nigerians and what percentage of the total work force are Nigerians. Also, show overall percentage of work to be performed in Nigeria and those by Nigerian resources relative to total work volume.
  • Provide a Nigerian Content Plan showing a detailed description of the role, work scope, man-hours and responsibilities of all Nigerian companies and personnel that would be involved in executing the work. Also provide details of Nigerian Content focal point or manager.
  • State proposed total scope of work to be conducted by Nigerian personnel (whether contracted directly or under subcontract agreements) with names and addresses including evidences of well-equipped offices and workshop; attach past experience of such patronage.
  • Specific to this work, provide detailed plan for staff training and development (including all software to be used, number of personnel, name of organization providing such training and evidence of past training record) for Nigerian personnel including description of any specific programs in place for transfer of technology and skills to indigenous businesses and Nigerians over the next five (5) 
  • Contractor must be willing and able to provide evidence of maximization of mode in Nigeria goods and services.
  • Provide details on any other Nigerian Content initiative your company is involved in.
  • Provide evidence of Nigerian Content Equipment Certificate (NCEC) from Nigerian Content Development & Monitoring Board (NCDMB) or evidence of the application of the certificates
  • All operators or project promoters in the Oil and Gas industry launching service contracts or other applicable projects with completion period of 12 months and above shall provide R&D cluster approved by the Board as part of the operator’s Nigerian Content plan for the project.
  • The Arrangement shall be in the form of an MOA and indicate how the operator will deploy the cluster for any R&D requirements during the contract period and the first 5 years of the service life of the field, facility or plant.
  • All service companies are required to sign a MoA with the relevant research clusters. The MoA shall indicate how the service company intends to use the relevant research clusters during project execution to the satisfaction of the Board. Researchers that meet the technical requirements of the Board shall be notified on the Research Cluster they belong to: and they will be required to upload research proposals relevant to their cluster unto the NOGIC JQS portal (http://www.nogicjqs.com) on request.
  • All tenderer to submit Human Capitol Development (NCD) training in line with the NCDMB HCD Guideline 2014.
  • Provide evidence of registration with Nigerian Banks, Insurance companies and Legal system in Nigeria and show evidence of operation for the pass years
  • Tenderers to provide verifiable evidence of ownership and name of the nominated vessel or binding memorandum of agreement and letter of offer between vessel owner and tenderer with Nigerian ‘CATEGORY A/AA’ companies in the NCDMB marine vessel categorization procedure that own the nominated vessel
  • Provide detailed description of the location and evidence of ownership (certificate of ownership, lease agreement, layout drawings and photographs) of in-country committed facilities & Infrastructure (assets, equipment, technical office, and administrative Space, storage, workshop, assembly area, repair & maintenance, testing, laboratory, etc) in Nigeria to support this contract or submit a credible and verifiable plan towards setting-up or leasing such facilities.

Interested contractors should also be registered on the NCDMB NOGIC JQS in the relevant product category.

Only Tenderers who are registered in the NJQS Site Survey Services (Product Code 3.10.03) category as at 7th December 2015 being the advert close date shall be invited to submit Technical bids.

  • All cost incurred in preparing, registering and prequalifying for this and other product/service categories shall be borne solely by suppliers.
  • Suppliers that are prequalified for this product/service category in NJQS must ensure that the name and contact details (physical address, email address and telephone number) of their company and authorized/responsible personnel is up-to-date in their company profile in the NJQS database.
  • SPDC will communicate only with authorized/responsible personnel of prequalified companies and not through unauthorized individuals or agents.

(2.0)  General Qualification Criteria and Tender Requirements

Interested Companies are required to submit tender documents accompanied with:

(i)      Certificate of incorporation with Corporate Affairs Commission (CAC) along with Forms; C07.

(ii)     Current Tax Clearance Certificates (2012 – 2014).

(iii)    Evidence of VAT Registration & Past VAT remittance. (iv)    PENCOM Certificate.

(v)     Evidence of Contribution to Industrial Training Fund (ITF).

(vi)    Company Audited Accounts for the last 3 years (2012 – 2014); b

(vii)   Evidence of Registration on the National Database of Contractors, Consultants and Service Providers with the BPP.

(viii)  Detailed Company Profile.

(ix)    Evidence of similar jobs previously executed or currently being executed (included letters of award, interim valuations, completion certificate).

(x)     Bidders must show evidence of registration with relevant professional bodies.

(xi)    Any Bid above 100 Million Naira for Goods and 300 Million Naira for works must be accompanied with 2%Bid Security.

(xii)   For Roads Construction/Rehabilitation, bidders shall provide evidence of ownership of equipment, or lease agreement notarized by court of Law.

(xiii)  A sworn affidavit disclosing whether or not any officer of FMA&RD or BPP is a former or present Director, Shareholder or has any pecuniary interest in the Bidder and that no Partner/ Director have been convicted in any Country for criminal offences related to fraudulent or corrupt practices or criminal misrepresentation or falsification of facts relating to any matter and that all the required documents presented in this bid are both Genuine and Up to Date.

(xiv)  The required Turn over for the Project is as in the Bidding Document.

(xv)   Any other document(s) that will enhance the application.

(2.1)  Bidding will be conducted through National Competitive Bidding (NCB) procedure as specified in 2007 Public Procurement Act.

(3.0)  Collection of Tender Document

A complete set of Bidding document shall be collected by interested Bidders from 17th November, 2015 at the address in 2.2 above on submission of written application accompanied by a non-refundable tender fee of ₦10,000,00. (Ten Thousand Naira) only per Lot in certified Bank Draft payable to Federal Ministry of Agriculture and Rural Development .The Bidding Document will be collected by hand by bidder or Bidder’s Representative.

(4.0)  Submission of Tender Documents / Closure

The completed tender documents must be submitted in three (3) copies one (1) original and two (2) copies, in 2 separate sealed envelopes clearly marked “Technical” and “Financial” and both sealed in a third envelop marked with the appropriate project title and lot number at the top right hand corner and addressed to the Permanent Secretary, Federal Ministry of Agriculture and Rural Development, FCDA Complex, Area 11, Garki – Abuja and deposited in the Tender Box at the address in 2.2 not later than 12.00 noon Tuesday, 29th December, 2015. Late submissions will be rejected.

(5.0)  Opening of Bids

Technical bids will be opened immediately after the close of submission in the presence of Bidders or their representatives, Non -Governmental Organizations, CSO’s, relevant professional bodies and interested members of the public. The Ministry of Communication Technology charged with the management and operation of Nigeria’s Communications Satellite. including NigComSat-1R. with a mission to manage and exploit the commercial viability of Nigerian Communications Satellite for the socio-economic benefit of the nation and a Vision to be the leading satellite operator in Africa. NIGCOMSAT Limited is wholly I committed to providing high-quality, reliable and professional services to meet the nation’s Telecommunication, Broadcast. Aviation Maritime. Tender Requirements

All interested contractors are required to forward the following documents along with the financial bids:

Important Information
