Invitation to Partner for Infrastructure Development under Build, Operate and Transfer Scheme

Introduction
Bowen University, Iwo, is a faith-based institution running a comprehensive university education for the generality of Nigerians. The University since its establishment in July 2001 seeks to add a distinctly moral dimension to tertiary education in Nigeria. Hence, its motto, ‘Excellence and Godliness’ encapsulates the ideals of this institution. As of November 2015, it has graduated 8917 students who are in various endeavours contributing to the development of this country. Presently, it has about 4,500 students with majority undertaking their studies in the main campus in Iwo, Osun State, and about 150 in the medical school in Ogbomoso, Oyo State. The proprietor is the Nigerian Baptist Convention, an association of Baptist churches in Nigeria, which was formed in 1914. Nigerian Baptists have been involved in the provision of educational services at all levels; elementary, secondary, medical, vocational, theological, teacher-training etc., since 1854 in every state of the country with evident excellent results.
The Task
Bowen University is seeking to partner with any estate developer, financial institutions, individuals, group of individuals, etc. towards the provision of students’ hostels on its campuses in Iwo and Ogbomoso in order to expand its facilities by providing more housing opportunities for her students, all of whom are required to live on campus. In addition, the University is expanding access to on-campus housing for its members of staff.
Presently, the University is exploring opportunities for the construction of the following:
(i.) One unit of two-bedded student hostel providing a total of 288 bed spaces, of 48 rooms on each floor on a three-floor building.
(ii.) Two staff transit guest houses of two floors providing a total of 30 one-bed-room flats, one of these to be located at the Teaching Hospital in Ogbomoso.
Such a developer who is ready to develop or finance any building under Build, Operate and Transfer (BOT) for a period not less than five years and not exceeding twelve years, must show ability to fund the building projects, proven records of performance and evidence of fulfilment of tax obligations to relevant government bodies. If it is a company, it must be registered in Nigeria. In the application to Bowen University, a profile of the company will be required.
Conditions
(i.) Under this partnership, Bowen University will provide all the architectural, structural, mechanical and electrical drawings, and further provide a schedule (without pricing) that will be used for the Bill of Quantities.
(ii.) The University will also provide the approval from the relevant Planning Authority of the State.
(iii.) Bowen University will provide the site plan showing the topography of the site and the location of the building within the overall layout plan of the University.
(iv.) Bowen University lands are covered by a Certificate of Occupancy issued in 1995 and it has no encumbrances whatsoever.
(v.) Bowen University guarantees the continuous occupation of the buildings by students and members of staff, who will be required to pay appropriate rents for the facilities.
(vi.) The University further guarantees regular and continuous payment to the financier or developer upon the terms so agreed in the contract documents until the expiration of the contract or partnership.

Upon the payment of ₦25,000.00 (Twenty Five Thousand Naira only) to the university, the individual/company is to obtain all the necessary building plans from:

Prospective bidders are required to submit the following documents:

(vii.) Evidence of Registration on the BPP National Database Platform for the Contractors, Consultants and Service Providers (Submit Interim Registration, the Report from Bureau of Public Procurement).
(4) OTHER REQUIREMENTS:
(i.) Company Audited Account for the last 3 years (2015, 2014 & 2013) by qualified Auditor and showing annual turnover. The Reporting Auditor shall submit Certificate of Registration with Financial Reporting Council (FRC).
(ii.) Company Profile and Technical qualifications of key personnel with evidence of experience of similar jobs; Evidence of Registration with Relevant Professional Bodies (including Architects, Civil Engineers, Builder and Quantity Surveyors etc.) is mandatory for construction works; (submit with CV and copy of certificates).
(iii.) Verifiable list of similar jobs successfully executed in the last 3 years including Letters of Award of Contracts; Valuation Certifications and Job Completion Certificates (please provide the contact addresses of the Clients).
(iv.) Evidence of Financial Capability to execute the Projects, from a reputable Bank (Evidence of Bank Support for the Projects if awarded will form part of the evaluation criteria).
(v.) Company Letter authorizing the Federal Ministry of Environment (FME) to verify all documents submitted for the projects with Relevant Agencies.
(vi.) The Minimum Turnover required for each project is as specified in the Bidding Documents.
(viii.) All Financial Bids of ₦300Million Naira and above for Works shall be accompanied with 2% Bid Security from a Nigerian Commercial Bank.
(5) COLLECTION OF TENDER DOCUMENTS:

3.0. COLLECTION OF TENDER DOCUMENTS
Interested companies can obtain the tender documents from the Tenders Board Secretariat, Procurement Department, 3rd Floor, Wing ‘B’, Room 317, NYSC Directorate Headquarters, Yakubu Gowon House, Maitama-Abuja between 11.00 am and 4.00 pm upon the presentation of evidence of payment of a non-refundable fee of Ten Thousand Naira (₦10,000.00) only for each lot at the cash office, 5th floor, NYSC DHQ, Maitama-Abuja.
4.0. TECHNICAL REQUIREMENTS
(i) Evidence of registration with Corporate Affairs Commission (CAC).
(ii) Company’s audited accounts for the last (3) consecutive years (2013, 2014 & 2015).
(iii) Evidence of Company’s current tax clearance Certificate for the last three (3) years (2013, 2014 and 2015)
(iv) Photocopy of VAT registration certificate and evidence of past remittances.
(v) Evidence of Compliance Certificate with the provision of Section 6(1) (3) of the amended Industrial Training Fund (ITF) Act No. l9 of 2011.
(vi) Evidence of current Pension Certificate clearance from PENCOM
(vii) Evidence of financial capability from a reputable bank.
(viii) Verifiable evidence of similar jobs successfully executed or being executed in Nigeria over the last five years, similar to the bidders lot of choice with at least 15,000,000 value in a single contract per year for five (5) years.
(ix) Comprehensive Company Profile with convincing proof of competence or production capacity to undertake the jobs within the required time frame.
(x) Evidence of technical, operational and managerial staff with relevant work experience in regards to the scope of work.
(xi) Evidence of registration on the Bureau of Public Procurement (BPP) National Database of Contractors, Consultants and Service Providers in line with provisions of section 5(h) of the PPA, 2007.
(xii) A Sworn Affidavit disclosing the following:
That all documents submitted are not only correct but genuine
That the Director(s) has/have never been convicted by any court of law.
That the firm’s Director or company is not bankrupt
Whether or not any of the officers of NYSC or BPP is a former or present Director of the company.
5.0. SUBMISSION OF TENDER DOCUMENTS
Bid documents must be spirally bound and duly signed on each page, the technical documents must be arranged in the order indicated in 4.0 (i-xii) above. Completed bid documents should be in two separately sealed envelopes labelled “Technical” and “Financial” (2 envelope system), both put in a bigger envelope clearly marked with the relevant Geo-political zone, Lot number and addressed to:

6.0 OPENING OF TENDERS
Opening of the bid shall commence immediately following the submission deadline at 11.00 am on Monday, 5th September, 2016 at the Conference Hall, 6th Floor, NYSC NDHQ, Maitama, Abuja.
Representatives of bidding companies, members of the public and Civil Rights organisations are invited to witness the Bid opening exercise.
7.0 GENERAL INFORMATION
(i) Due to complexity of the job and timely delivery, no company shall apply for more than one (1) Lot.
(ii) Failure to fulfil any of the conditions in 4.0 (i-xii) above shall render an application invalid
(iii) The National Youth Service Corps (NYSC) shall verify the authenticity of evidence submitted by bidders with the relevant authorities. Any company found to have submitted forged documents will be prosecuted.
(iv) Nothing in this advert shall be construed to be a commitment by the National Youth Service Corps, nor shall it entitle responding contractors to seek any indemnity from the NYSC by virtue of such contractors having responded to this advertisement/invitation to tender.

The Two (2) envelopes should be put into a bigger envelop and clearly marked “Pre-qualification, Technical/Financial Bid”. The name of the Company should be boldly written on the reverse side of all the envelopes. (All Documents should be in ring binding)
