INVITATION FOR TECHNICAL AND FINANCIAL BIDS FOR THE PROCUREMENT OF ESSENTIAL SERVICE UNDER 2018 BUDGET.

(1) INTRODUCTION:
The Federal Ministry of Youth and Sports Development in furtherance of its statutory mandate intends to implement some Capital Projects in the Works/Goods/Services Categories in line with Budgetary Appropriation for the Financial Year 2018 and Procurement Activities for the 19th Edition of National Sports Festival in accordance with Extant Provisions of section 19 and 25 of the Public Procurement Act 2007.
(2) SCOPE OF THE PROCUREMENT
The proposed procurement comprise Works (Construction, Rehabilitation, Design, Production, Development), Goods (General Supplies) and Services of the Ministry towards implementation of budget for the financial year 2018 and funding for the 19th National Sports Festival.

(3) ELIGIBILITY CRITERIA:
Interested Firms or Contractors should submit their tenders (one separate envelope for “Technical” and another separate envelope for “Financial” and enclosing the two envelopes in a bigger envelope) properly addressed along with the following requirements:
(3.1) MANDATORY REQUIREMENTS:
(i) Evidence of Certificate of Incorporation with Corporate Affairs Commission (CAC) including Form CAC2 and CAC7;
(ii) Evidence of Company Income’s Tax Clearance Certificate for the last three (3) years (2016/2017/2018) and valid till December, 2018; with average turn-over (as may be determined in the Standard Bidding Documents)
(iii) Evidence of current Pension Compliance Certificate valid till 31 December, 2018;
(iv) Evidence of current Industrial Training Fund (ITF) Compliance Certificate valid till December, 2018;
(v) Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till December, 2018;
(vi) Evidence of Registration on the National Database for Registration of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 1/1/2019 or valid Certificate issued by BPP;
(vii) A sworn Affidavit disclosing whether or not any officer of the relevant committees of the FMYSD or BPP is a former or present Director shareholder or has any pecuniary interest in the bidder and confirm that information presented in its bid are correct in all material particulars;
(viii) Unabridged Company Audited Annual Report for the past three years (2015, 2016, 2017);
(ix) Evidence of financial capability to execute the project including Reference Letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
(x) Company Profile with Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications;
(xi) Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
(xii) List of Plants/Equipment with proof of Ownership/Lease (Where applicable);
(xiii) For Joint Venture/Partnership, Memorandum of Understanding (MOU) should be provided (all the eligibility requirements are compulsory for each JV partner)
(xiv) A sworn affidavit that personnel and components to be used in the execution of the proposed services shall form at least 60% composition in line with Federal Government Executive Order – 003 circular on Local Content Preference.
(xv) All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.) and e-mail address. The Letter Head Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of page, duly signed by the authorized officer of the firm;
(xvi) Submit an affidavit disclosing that the company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceeding; and
(xvii) Submit an affidavit that the company is not having any director who has been convicted in any country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter.
(3.2) Other Requirements to be Submitted are as Follows:
(i) Evidence of Registration with Abuja Environmental Health Officers Registration Council (EHORECON) for Service Providers bidding for Provision of Cleaning Services;
(ii) Evidence of Registration with Nigeria Security and Civil Defense Corps (NSCDC) in the case of provision of Security Services; and
(iii) Only Companies included in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorized representatives should bid for the procurement of vehicles;
(iv) Original Equipment Manufacturers (OEM) Certificate or Authorization letter from OEM’s or Accredited dealers in case of Sports Equipment for Lot A18 and other Procurement of Sports Equipment as applicable in the Standard Bidding Document.
(4) COLLECTION OF TENDER DOCUMENTS:
Interested Companies are to collect the Standard Bidding Document (SBD) from office of the Director (Procurement Department), room 521, Fifth Floor, Federal Ministry of Youth and Sports Development, commencing from Tuesday 20August, 2018 (between 8:00am-4:00pm, on work days) upon the payment of non -refundable tender fee of Ten Thousand Naira only (N10,000.00) by generating CBN ‘Remitta’ payable to Federal Ministry of Youth and Sports Development (Federal Ministry of Youth Development Remitta Platform No.051300100100).
(5) SUBMISSION OF TENDER DOCUMENTS:
Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies each of the technical and financial bids with soft of financial bid only in MS Excel format, packaged separately in sealed envelopes and clearly marked as Technical Bid” of “Financial Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to (The Permanent Secretary, Federal Ministry of Youth and Sports Development, Federal Secretariat Complex, Phase II, Bullet House, Shehu Shagari Way, Abuja) and clearly marked with (the name of the project and Lot number). Furthermore, the reverse of each sealed envelope should have/bear the name and address of the bidder and drop/deposit same in the designated Tender Box in the office of the Secretary (Tenders Board) located on room 521, 5th floor, block ‘E’ not later than 12:00 noon of 24 September, 2018.
(6) OPENING OF BID:
The technical bids will be opened immediately after the deadline for submission by 12noon, 2 October, 2018 at the Permanent Secretary’s Conference Room, 2nd floor, Block D, in the presence bidders or their representatives, while Financial Bids will be kept un-opened. Please, ensure that you sign the Bid Submission Register in the office of Director (Procurement Department), room 521, Fifth Floor Federal Ministry of Youth and Sports Development, as the Federal Ministry of Youth and Sports Development will not be held liable for misplaced or wrongly submitted bids. (7) GENERAL INFORMATION
(a) Bids must be in English Language and signed by an official authorized by the bidder;
(b) Bids submitted after the deadline for submission would be returned un-opened;
(c) Bidders should not bid for more than two (2) lots
(d) All cost will be borne by the bidders;
(e) All pre-qualified bidders will be contacted at a later date for financial bid opening, while bids of un-successful bidders will be returned un-opened;
(f) The Federal Ministry of Youth and Sports Development is not bound to pre-qualify any bidder and reserves the right to annul any part or the entire Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
(8) PLEASE NOTE THAT:
(i) The Ministry may verify any or all of the claims made by the applicants and may disqualify any company whose claims are found to be false in addition to other sanction that may deemed necessary;
(ii) Bidders who have worked for the Ministry and have history of poor performance, abandonment, termination and or prolonged contract execution period arising from dilatory conduct of the contractor need not apply;
(iii) All submissions pages must be duly initialled by the company; and
(iv) All submissions must be accompanied with a sworn affidavit indicating that all documents submitted are genuine and verifiable;
(v) The bidding public shall note that the life period of this advertisement is for a period of six (6) weeks and publication of results or technical and Financial” as well as awards will be placed on the Ministry’s Notice Board at the appropriate time;
(vi) For Contracts involving design and production, it is to be noted that the Ministry shall not be held liable for costs incurred in producing such a design;
(vii) Furthermore, the Ministry shall not in any way be responsible for costs incurred by a prospective bidder for producing any item prior to the communication of the approval of a design.

The proposed project will involve the construction, Installation and operation of coal water slurry factory at Chikara Village in Koton Karfe, Kogi Local Government Area, Kogi State. Locally available coal from nearby state will be converted to the coal water slurry after crushing and mixing with water. The slurry will be used as fuel in boiler which is considered a feasible alternative to the heavy fuel oil currently used as a boiler. The main components of the coal water slurry includes: coal, water and other additives in the coal milling process to create a liquid fuel with similar flow properties as oil

(1) INTRODUCTION
EROTON E&P Company Limited; the operator of NNPC/Eroton JV invites interested and reputable contractors with suitable equipment and relevant experience to tender for the provision of electrical wireline services in OML 18. The Company plans to initiate a field development programme. The service is required to support Company’s 2018-2021 Drilling and Completion operations.
(2) SCOPE OF WORK
The Service includes the provision of personnel and equipment required for the execution of electrical wireline services aboard a drilling rig (and/or any other potential unit) operating in OML18 swamp Nigeria, for field development or any other additional Permit Area in which COMPANY has the right to conduct petroleum operations within Nigeria. The contractor shall be responsible for the provision of the following:
(a) Electrical wireline equipment and services
(b) Real time reporting
(c) All other related equipment, tools, consumables, spare parts and experienced personnel necessary to satisfactorily perform the above services
The contract duration shall be for a period of two (2) firm years plus one (1) year optional extension.
(3) MANDATORY REQUIREMENTS
(a) To be eligible for this tender exercise, interested contractors are required to be pre-qualified in the 3.04.09 Electrical logging services category of the NipeX Joint Qualification (NJQS) Database. All successfully pre-qualified suppliers in this category will receive Invitation to Technical Tender (ITT).

(4) CLOSING DATE
Only Tenderers who are registered with NJQS Product/category (3.04.09 Electrical logging services) as at September 14, 2018 being the advert close date shall be invited to submit Technical Bids.
(5) NIGERIAN CONTENT
Bidders are to note that they will be requested during the technical tender to give full details of their relevant strategy to ensure that they fully comply with provisions of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act 2010. Consequently, bidders’ submissions shall be evaluated strictly with the minimum evaluation criteria defined in ‘The Act’. Failure to meet the Nigerian Content requirements is a “FATAL FLAW.”
In line with the above, Tenderers responding to this advertisement are required to submit the following in compliance with the Nigerian Content Act, 2010:
(1) Demonstrate that the entity is a Nigerian-registered/owned company. Submission of certified true copies of CAC forms 10, 02 & 07 (or its equivalent; CAC 2.3, 2.4, 2.5, etc.) including company memorandum & article of association and other evidence of entity’s incorporation, shareholding & ownership structure in Nigeria.
(2) Develop a Nigerian Content Plan that demonstrates the full utilization of Nigerian labour and services with detailed description of role, work scope and man-hours in order to achieve the minimum target as set out in the requirements of the NOGICD Act 2010 (45% Spend; Wireline Services) for this project. Where in-country capacity is inadequate, propose innovations to bridge the gap
(3) A plan of how it intends to give first consideration to materials, manufactured as well as assembled goods of Nigerian origin which shall include a breakdown of all materials and consumables to be utilized and identifying those that are found locally, finished products and materials that will be procured from Nigerian manufacturing and assembly plants, finished goods that order can be placed from outside Nigeria through Nigerian authorized vendors and accredited agents and those that would be directly imported
(4) Details of the company’s corporate organizations, overall human resources structure (management, supervisors, senior and junior skilled officers, etc.), identifying positions manned/occupied by Nigerian nationals with evidence of type of employment in-country and identifying the positions manned/occupied by other nationals
(5) Where the bidding entity lacks capacity, genuine alliances with other Nigerian companies or multinational companies for the purpose of technology transfer shall be encouraged. The alliance/joint venture shall be executed with binding Memorandum of Agreement (MOA) signed by chief executives of both entities stating clear work-share ratio among the parties and time frame for growth or transfer to be achieved.
(6) A detailed description of the location of in-country committed facilities and infrastructure (assets, equipment, technical office, and administrative space, storage, etc.) in Nigeria to support this contract.
(7) Tenderers to submit a detailed training plan which shall provide sustainable training and development (including certification as applicable) for Nigerians in line with the Human Capacity Development Initiative Guideline of the Nigerian Content Development and Monitoring Board’s (NCDMB). The training plan will include contract-specific training and estimated man-hours. Tenderer is required to submit MOA with Oil and Gas Trainers Association of Nigeria (OGTAN) trainers to support their training plan, which shall be 15% of the project Man-hours or 3% of the total contract sum.
(8) Provide evidence to show that a minimum of 50% of the equipment to be deployed for the work is owned by the Nigerian subsidiary if international or multinational company is working through the Nigerian subsidiary including equipment list (Tenderer to provide verifiable evidence (purchase receipt, bill of sale, etc.) of ownership of equipment in executing this contract.
(9) Provide evidence of approved Nigerian Content Equipment Certificate or status of the application submitted to NCDMB for the certificate for the procurement of all equipment, systems and packages to be supplied on the contract (where applicable). Where Tenderer intends to use subcontractor(s)/supplier(s), Tenderer shall provide same information for the nominated supplier(s)/sub-contractor(s).

(11) Provide evidence of completed registration on NCDMB NOGICD JQS portal.

(6) ADDITIONAL INFORMATION
(a) Interested suppliers must be pre-qualified for this product/service category in NJQS.
(b) Full tendering procedure will be provided only to contractors that have been successfully pre-qualified in NJQS.
(c) This advertisement shall neither be construed as an Invitation to Tender (ITT) nor a commitment on the part of EROTON to award a contract to any supplier and/or associated companies, subcontractors or agents.
